Adverse action is a defined process employers must follow when considering disqualifying a candidate based on the results of a background check. Our solutions help employers follow the adverse action process outlined by the Federal Credit Reporting Agency (FCRA) and state laws.

Employers can submit an adverse action request to Orange Tree directly on the ClientConnect® site . Once submitted, and subject to state specific information gathering Orange Tree will send a pre-adverse action letter to the candidate through the CandidateConnect® portal or USPS and provide a copy for employers to access online. If there is no response or dispute within your pre-established waiting period, you can submit a request for Orange Tree to send the final adverse action letter on your behalf or send the final letter automatically. If the candidate responds with a dispute, we will reach out again and confirm your disqualifying decision to restart the process after the reinvestigation.
